1. Affirm that I have read and understood the FAB Implementation & Terms of Reference “TOR” and agree to be bound by it.
2. Affirm that I am eligible to apply to become an FAB member, in accordance with the eligibility criteria set out in the TOR.
3. Understand that selection to the FAB is at the discretion of the Club and will be conducted in accordance with the TOR.
4. Consent and grant to the Club an irrevocable, royalty free, sub-licensable, right and license (in perpetuity and on worldwide basis), to use my name, voice, photograph, audio recording, video recording, and any other portrayal or characteristics of any kind as the Club deems fit, in relation to my involvement with the Club, for the promotion of the Club, the FAB and the Club’s sponsors and partners, anywhere in the world and on any medium including physical, broadcast or digital (including on the internet and social media) or any other media which may become known in the future. Further, I waive all moral rights and personality rights, including any right to have my name affixed to each usage of my image, under applicable law in India, to the extent permissible, in respect of the aforesaid license grant.
5. Consent to the Club including my name and application details as part of its database.
6. Affirm that, if successful in my application, I will conduct myself and act responsibly in accordance with all lawful and reasonable instructions of Club personnel and abide by all such applicable policies and regulations instituted by the Club as notified and made available to me. Further, I affirm that I will respect all my fellow FAB members.
7. Agree and understand that the Club reserves the right to decline or disallow my application, at any time, should I commit or be in breach of any of these Terms.
8. Acknowledge that I may be required to provide certain information that can be used to identify me or in relation to which I am identifiable (“Personal Information”), which may include:
(a) Name;
(b) Email address;
(c) Residential address;
(d) Phone number; and
(e) Social media handles.
9. Agree and understand that I hereby consent to the use of Personal Information for the purpose stated in these Terms.
10. Agree and understand that the Club may use my Personal Information and other information received and collected from me in relation to my application and in relation to any requests or actions sought by me over the course of my communication with the Club, including for the purposes of undertaking the FAB selection process, verifying my application, sending me updates or to contact me upon my request and when otherwise necessary. The Club may also use Personal Information for auditing, research and analysis purposes.
11. Agree and understand that when the Club uses third parties to assist in its processing of my Personal Information, the Club shall undertake best efforts to require that they comply with the Club’s Privacy Policy and any other appropriate confidentiality and security measures. I further acknowledge that the Club may also share such information with third parties in limited circumstances including when complying with legal process, preventing fraud or imminent harm, ensuring the security of its network and for other legitimate uses prescribed under law.
12. Acknowledge that my Personal Information may be retained and may continue to be used until:
(a) the relevant purposes for the use of my Personal Information are no longer applicable; and
(b) the Club is no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain my Personal Information, and the retention of my Personal Information is not required for the establishment, exercise or defence of any legal claim.
13. Understand that I am entitled to withdraw consent for processing of my Personal Information by emailing a specific request at the following email address: compliance@kbfcofficial.com. Withdrawal of consent with respect to all or any part of my Personal Information may result in immediate withdrawal of my eligibility to be considered for the FAB for which such Personal Information is necessary to provide. I acknowledge that my withdrawal of consent shall not operate to cause the Club to cease any processing of my Personal Information that is necessary for compliance with applicable law or the order of a court/executive authority, or purposes for which non-consensual processing is permitted under applicable law.
14. Understand that I am entitled to seek:
(a) a summary of my Personal Information being processed by the Club and the processing activities being undertaken by the Club; and
(b) correction, completion and updates to the Personal Information stored with the Club, by contacting the Club through email at compliance@kbfcofficial.com.
15. Acknowledge that the Club may share my Personal Information with third party service providers engaged by the Club, for the purpose of storage and processing in relation to the Personal Information provided by me. Any third-party service provider (as may be applicable) with whom the Personal Information is shared will be obligated to comply with the same standards as applicable to the Club in relation to maintaining the security of the information provided by me.
16. Understand that to the extent that I do provide the Club with Personal Information, the Club wishes to maintain accurate and current Personal Information. Where the Club collects Personal Information from me, should I need to update or correct that Personal Information, I can contact the Club in the manner set out above (my rights with respect to my Personal Information) and the Club will make reasonable efforts to incorporate the changes in my Personal Information that the Club holds, as soon as practicable.
17. Understand that the Club shall take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of my Personal Information that the Club collects and stores. These include internal reviews of the Club’s data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where the Club stores my Personal Information. The Club has a comprehensive information security program and information security policies, which contain managerial, technical, operational and physical security control measures adopted by the Club for the protection of Personal Information.
18. Acknowledge that while the Personal Information gathered by the Club is stored securely using several information security applications including firewalls, security is always relative, and the Club cannot guarantee that its security measures are absolute and cannot be breached. Data, which is transmitted over the internet, is inherently exposed to security risks or threats. For instance, information transmitted via chat or email can be compromised and used by others. Therefore, the Club cannot guarantee any security for such information in the course of transmission through the internet infrastructure or any unsolicited disclosures made by me or any other user. By accessing this Form, I understand and agree that my information may be used in or transferred to countries other than India.
19. Understand that in the event I have any complaints or grievances in respect of the Club’s processing of my Personal Information, such complaints or grievances can be sent by email to: compliance@kbfcofficial.com. I am informed that the Club shall provide a response to any complaint or grievance within fifteen (15) business days of the receipt of the complaint or grievance, unless a shorter period is prescribed under law. Any complaint or grievance raised by me must include the following information:
(a) Name and contact details: name, address, contact number and email address;
(b) Description of the complaint or grievance in relation to which such complaint or grievance is made;
(c) A statement under penalty of perjury that the information provided in the complaint or grievance is accurate; and
(d) My signature.
20. Warrant that I am above the age of 18, have read and understood the contents of these Terms and expressly consent to the terms contained herein. I understand and freely accept all risks arising from my application including those arising from the acts or omissions of the Club or representatives of the Club. These Terms shall be binding upon me and my heirs, legal representatives, and assigns. The courts in Kerala, India shall have sole and exclusive jurisdiction over any disputes arising out of or in relation to these Terms.
21. Agree, to the maximum extent permitted by law, to release and hold harmless the Club and its directors, officers, coaches, employees, personnel, agents and representatives from and against any present or future claims, demands, losses, damages, liabilities, costs and expenses for any and all illness or injury to me, including my death, or for any other damage that I may suffer, or for which I may be liable to any other person, related to my involvement with the FAB application process, or the FAB, resulting from any cause, including but not limited to any deliberate negligence on my part.
